Clarification regarding the registration of agricultural machinery

The Type Approval Authority periodically receives complaints from business entities that territorial bodies of the State Production and Consumer Service refuse to register agricultural machinery. They motivate this by the fact that type approval certificates were issued for single samples or batches and do not meet the requirements of Appendix 7 to the Technical Regulations for type approval of agricultural and forestry tractors, their trailers and replaceable trailed machines, systems, components and individual technical units, in particular, absence of Appendix 2 «Test Results» and Appendix 3 «Sample signatures of persons authorized to sign certificates of conformity to the approved type».

WE EXPLAIN! According to Clause 8-2) of Clause 4 of the «Procedure for departmental registration and deregistration of tractors, self-propelled chassis, self-propelled agricultural, road construction and reclamation machines, agricultural machinery, other mechanisms», proved by the Cabinet of Ministers of Ukraine Resolution No. 694 dated 07/08/2009 (as amended by the CMU Resolution dated 12/04/2019 No. 1168) it is provided that for the registration of the above-mentioned equipment, it is mandatory to submit a certificate of conformity to the approved type to the territorial bodies of the State Production and Consumer Service. This certificate must be issued by the manufacturer or his authorized representative on the basis of the type approval certificate - for machines that are subject to the Technical Regulation on the type approval of agricultural and forestry tractors, their trailers and interchangeable towed machines, systems, components and individual technical units, approved by the resolution of the Cabinet of Ministers of Ukraine dated 28.12.2011 No. 1367 (hereinafter - Technical Regulation of Type Approval) or a type approval certificate issued for unit samples of machines by a conformity assessment body appointed in accordance with the established procedure to carry out type approval activities.

That is, according to the above-mentioned Procedure for departmental registration, the Technical Regulations do not establish !!! requirements for a type approval certificate issued for a single sample or batch of machines.

In addition, the functions of territorial bodies of the State Production and Consumer Service do not include inspection!!! the correctness of filling out type approval certificates.
